Going Back to an Old Claim
My question involves workers compensation law for the state of: CT
I was injured nearly 10 years ago at work and received compensation for medical treatments, surgery, and wages lost for time off. At that time my surgeon told me that I would most likely have problems with the area of surgery (disc herniation L4/L5) years down the road, thus I chose to keep my comp case open. Several months ago I started developing pain in my left hip and thought nothing of my spine, I thought it was arthritis. After seeing an ortho who ordered an MRI, I was told that the herniation returned, same level as prev, and was most likely due to prev injury and I was referred to his surgeon who confirmed this, as well as telling me that I need surgery again, only this time a fusion. At this confirmation, I returned to the law office that handled the case originally, as well as the surgeon that did my surgery.
I was informed that despite the fact that the injury was due to the previous injury, it would be difficult to win the case because so many years had lapsed without me having spinal difficulties. That was in January. A claim representative was only just recently located, I have lost nearly two months of work because my health has deteriorated to the point where excruciating spasms have now turned into my no longer being able to walk upright, and I've used up all of my paid time off. HOW MUCH LONGER WILL I HAVE TO WAIT FOR COMP TO REQUEST AN IME OR JUST APPROVE ME??!!! If I had known this would happen, I would have closed my case a long time ago.
