    Default Probation and Failure to Appear

    My question involves criminal law for the state of: ILLINOIS

    Two Years ago i was put on felony probation for a class 4 assault charge for fighting with an ex. weeks before my probation expired a warrant was filed for not reporting and i didnt know about it until i was picked up in another state. the state i was picked up in was an adjoining state of illinois and they told me the warrant was only good in adjoining states but then read off tennessee as one of the adjoining states even though it doesnt touch the state of illinois. is there a way to verify that the warrant is no good here in tennessee or if it has a pick up radius on it? also if i skip the court date because it is no good where i live, will the failure to appear charge be a misdemeanor or a felony? any info would be very helpful because im not sure i can afford more bullshit from these people over nothing. thx.

    My question involves criminal law for the state of: ILLINOIS

    I RECENTLY FOUND OUT I HAD A VIOLATION OF PROBATION WARRANT FILED FOR NOT HAVING A RIDE HALF WAY ACROSS THE COUNTRY TO REPORT. I HAVE SINCE BONDED OUT AND A COURT DATE BEEN SET. IF THE COURT DATE IS SET FOR REVECATION OF PROBATION WILL IT BE SETTLED THE FIRST TIME I APPEAR WHERE THEY CAN HOLD ME AND SENTENCE ME THAT DAY OR WILL THERE BE MULTIPLE COURT DATES CONCERNING THE ISSUE BECAUSE I HAVENT BEEN APPOINTED COUNSEL OR ANYTHING JUST A COURT DATE. THX.

    What, exactly, were you violated for?

    It could be settled the first time you report to court.

    You need a lawyer.

    sorry about the caps. i was originally put on probation for domestic violence but they are trying to revoke it because i wasnt able to keep taking trips to illinois and tennessee rejected the transfer. if you feel pretty strongly it will be a one time court hearing and that they could jail me then and there then i doubt going would be my best option. would the bench warrant filed be a misdemeanor or a felony? is there a way to verify if there is a pick up radius on the warrant because i was told when i bonded out it that the warrant was only good in adjoining states. thx for the response.

    If the original charge was a felony, the pickup range could be nationwide.

    (I have no idea what the court's policy is on that.)

    You could also face other problems with having an outstanding warrant, the revocation of your driver's license being one.

    one last question and thanks for the advice. is it up to the judge or the attorney of the state to decide whether to have you extradited or not? whos in charge of telling the out of state jail thats holding you whether they want you or not? thx.
