    Default Emancipation Questions

    My question involves emancipation laws for the State of: Colorado

    I'm 15 I live in Colorado I would like and need to be emancipated. I just moved back in with my mother after 4 years. I was living with my father in Oklahoma. Things got messed up so I was sent back. I left in the first place with good reason. Now I'm back in this house dealing almost the same problems. I would really rather not take my mother to court. I know I can live on my own and take better care of my self than her. So I have some questions.. 1. Can't my mother just sign the forms with out us going to court? 2. Am I able to get forms from another state that I used to live in? Or the state I'm moving to if I get emancipated.. 3. Am I even aloud to move to another state after I'm emancipated?. Yep if you could help me out.. Thanks. =]

    Yea I know.. I looked it up.. I can't find anything about me getting forms from Nevada or Oklahoma I used to live in both.. Or if I can get forms from the place I plan on moving too... Texas. I'm kinda stuck.

    You don't live in Nevada or Oklahoma, and if you followed the instructions for this forum you already know that emancipation in Oklahoma wouldn't help you because it relates to a minor's ability to enter into binding contracts.

    You've read this thread, right? Then you know that it appears possible to emancipate in Colorado, but there's no statute or other obvious guidance we can point you to. You've read this thread, right? So you know that "I don't get along with mom" isn't a basis for emancipation in any state, and that you haven't articulated a single factor that would weigh in favor of emancipation.

    I've talked to a lot of people out here about it.. My school counselor said that Colorado doesn't do emancipation..He talked to the other councilors for me and they all said the same thing.. They said Colorado only recognizes it. I said I don't get a long with my mother because it is true.. I didn't want to type out everything about it and the issues are mainly with my alcoholic step dad.. The issues are my mother has never done a thing about the things he did to me. Thanks for that any way.. I did read those posts.. I've read what you put on there.. There is still no way I can get emancipated out here.

    So I'm going to go live with my dad in Oklahoma again this summer.. Stay there past my birthday and get emancipated out there.. The only way I know to do this..

    Could someone also answer my other questions..
    Do I have to take my mother to court or can she just sign the forms?
    Am I able to move to another state once I'm emancipated?

    If there is a basis for your father to modify custody, so that you live with him instead of your mother, your father should petition the court to modify custody. Neither running away nor emancipation are appropriate means to circumvent a custody order between parents.

    And again, emancipation in Oklahoma wouldn't help you because it relates to a minor's ability to enter into binding contracts, not to a right to live independently (or ignore a custody order's provisions about which parent has custody).

    My father wont take custody of me.. He's about to leave his latest wife and kids. He only tolerates me staying with him for a while. I'm not running away.. If my dad wasn't being such an ass at the moment I would be free to go between them as much as I like as long as I follow the rules. As far as I knew(until looking at this site) You can get emancipated in Oklahoma I had a couple of friends do it. The school counselor told us it was possible.

    I'm not running away, My father wouldn't take custody, & I can't live in either house. I can take care of my self better then they have.

    You're not listening.

    Yes, a minor can get emancipated in Oklahoma. Once a minor is emancipated in Oklahoma, they can sign a contract.

    But NOWHERE in the laws of Oklahoma does an emancipated minor have the right to move out of the house or live independently. An emancipated minor has only one right that a non-emancipated minor has not - the right to sign a contract.
