My question involves criminal law for the state of: New York.
My wife received a DWI the other night (1st offense), ticketed for blowing over 0.18. She's beside herself with shame & embarrassment and doesn't even want to drive anymore. However, on the ticket, the officer entered the wrong address for her. It was an address that she lived at 5-6 years ago, but her license, registration and insurance card all have our current address on them. We're not even sure how they came up with the old address.
So my question is, is there some kind of legal loop hole or does it not matter that the wrong address was entered? What can she expect as a penalty if it doesn't matter and she goes to court with a lawyer?
