    Default Ex Misrepresented His Income

    My question involves child support in the State of: NC

    My child support order was first established in may 2001. A modification for increase was done in august 2008. I just found out in Feb 2009 that my ex misrepresented his income on both occurences.

    -In 2001, he stated he made 38,000 per year working for his father's business. His actual income was reported as 64,000 that year.

    -When we did the modification to increase child support in aug 2008 he reported his income as 106,000, actual income was 162,000.

    In Dec. 2008, he filed for a child support modification to reduce child support because he said he lost his job. He lied in pretrial hearing and told the judge he could not find a job, he had no income and could not find a job. But in actuallity he left his employment making 162,000 per year to start his own business.

    My question is this can I do anything about him lying about his income in 2001 when child support was set and can I do anything about him lying about income in 2008 for modification increase?

    What is the best way to handle him currently trying to reduce child support saying he doesn't have a job when he has started his own business?

    BTW, He hasn't paid child support at all in 3 months.....................desperately need help!!!! Any insight would be very much appreciated.

    You can't do anything about the past misrepresentations.

    All you can do is that the next time you are in court, make sure that the court is aware of his actual income at that time.

    Well - where are you in your process right now? Do you have a court date pending or are you just trying to get information?

    Let me say this:
    I provided support to a woman whose ex misrepresented his income. Said he was on SSI - no other job. He wanted a downward mod. By the time we were done, we learned he has 14 income producing properties in his state. 14!! AND a job. Long story short - he didn't get a downward mod. What he did get tho was an increase in what he had to pay, a seizure of his checking account and the record was set straight.
    All is never lost.
