I signed a contract that stated if I did not stay 2 years, the money owner sent me to assist in the move would be paid back if I quit or was terminated.
The person I went to work for does not have a license to practice in the medical field I am licensed to practice. In fact the person I was working for has no training,but is the owner of the company. Owner of company repeatedly barged in when I was with patients. I explained to owner that is a violation of patient's privacy and a very serious issue. Owner continued to do it. Owner also changed my reports on patients. Owner told me I would be paid twice a month on specific days; I was not paid in a timely manner and frequently had to request my check over and over. I was salaried so didn't see the problem with being paid on dates promised. On more than one occasion there were not sufficient funds when I deposited my payroll check so funds did not go in for several days.Owner continued to make work environment very unpleasant and behavior became more bizarre and paranoid. Owner constantly spoke in derogatory terms about persons who held the position prior to me. Turn-over in other employees was constant; mainly due to owner's behavior and the pay issue. I found out owner was impersonating me online and used my signature on at least one occasion. Other former employees can and will back up all of the above. The work environment was much worse than I care to even go into in this forum but bottom line is: my reputation and my career seemed to be in jeopardy by association due to owner's antics involving other issues, but even more serious was what I preceived as identity theft by owner. A company contacted me and offered me a job and some help with moving expenses. I took the job offered and felt I really was left with no other choice as I was under a lot of stress with the goings on at what was then my current job.
I explained to owner why I was leaving and owner,of course, said I would have to pay back the monies stipulated in my contract. I countered that I had every intention of staying at the owner's place of employment were it not for owner's actions. Owner is now saying I will be turned over to collection agency for monies. I sent owner a certified letter outlining everything I felt was a breach of contract by owner. Am awaiting a response.
Can a contract become null and void if employer behaves in such a manner,as explained above, that an employee is left no choice but to take another job?
