    Default B and E from 1974 Arrest

    My question involves criminal law for the state of: Kentucky

    I was arrested in KY Aug 1974 for b and e of a department store.

    Yes I was there.

    It was referred to the grand jury Sep 1974.

    I was working with military police at the time. They asked the court/state police to drop the charge. They appeared to drop it.

    I have had numerous background checks. The arrest and charge show up with the FBI but with no depostion.

    I have led a troublefree life since then.

    I took up shooting about a year ago. I applied for and received my concealed carry Oct 2008 from OH.

    I just got a call from Sheriff (Feb 2009) that there was a problem. It seems there is a problem in that the OH BCI cannot find a deposition for that arrest.

    I called the county where it happened-initially they could not find it either. I called back again and they finally found it. They said it had been sent to the KY State Archives. I will talk to them tomorrow.

    I want to get it expunged.

    Has the charge been dismissed if sent to the KY State Archives. Can I get expunged if there is no stature of limitations and it has not been dismissed.

    I am afraid that I might re-open it also. Could that happen?

    Arrest does not equal conviction. Innocent until proven guilty and all that.
