Default First Offense Fraud, Sentenced, What Options
My brother, early twenties, was recently sentenced to 36 months of imprisonment in a federal case because of a violation of 18 USC 1029 (a) (3), fraud. He's currently being held in NY.

He has no past offenses and I feel that our lawyer was not knowledgeable enough on federal cases to provide the best options for him.

I'm looking for advice on what options he may have to reduce his sentence, go on probation earlier, or anything that would get him back to his family and child sooner. Would something like the Shock Incarceration be an option? Would it apply to a federal case?

If he is already sentenced there isn't much anyone can do. If he doesn't get into more trouble while in prison he will get out after doing 80% of his time.

NOT TRUE. In the federal system you have to serve your ENTIRE sentence. There is no longer any time off for good behavior or for any other reason.

Two Words: Micahel Vick... he is getting off a few months early to go to house arrest.. you do have to do your entire sentence but can get house arrest at the end
