    Default Possible Child Support Fraud

    My question involves child support in the State of: New Jersey.
    I am 20 years old and my mother has been receiving child support for years. I don't have contact with my father and he recently took my mother to court to have me emancipated and the child support terminated. His request was denied. My mother is unemployed and still receiving the child support.
    Now last year my mother kicked me out of the house upon returning home from college and I currently reside in PA. Now for the last year I have found full time employment and am trying to make ends meet on my own. However, I haven't received or seen a dime of the support and since I am no longer living under her roof the things she uses the support for such as her mortgage no longer apply since its not my residence. I am currently receives medical benefits and food stamps along with receiving rental assistance from the local assistance office because I am not receiving any money.
    The court rendered that child support would be paid until I reach the age of 22. However I had to take the year off of school because of my financial situation, neither parent helping. But am going back next fall.

    How do I get the child support? and is my mother using the child support fraudulently if she doesn't support me with rent, car insurance, school, food, clothes, etc?

    What did the court have to say about you living in a different state and not being supported at all by your mother? Is the child support order still in effect bc of a back order?
    Once you turn 18 your emancipated, period.

    Not necessarily. It really depends on what the court order says, which she is not aware of. Their court order may state that her father is to pay until the child is 22 or graduated from college.

    OP, does your father know that you took a year off college? Does he know the situation between you and your mother? If not, then let him know. You will still not be entitled to the child support though. If your dad owed back support he will still be required to pay

    They thought me getting residency for school was very honorable and they just want to see me back in school by this fall.
    My mother has lied about supporting me. Telling the court she is paying my rent and helping me in everyway possible. But she isn't. Haven't seen a dime.
    He knows I took the year off but he thinks I'm seeing all of the child support and I haven't talked to in years. There was a idea brought up to have the child support sent to me, but it was never talked about it detail. They said since I am over the age of 18 I can have it. Not sure if that's true or what I would have to do to get it.
    The child support isn't back ordered. It was decided that the support was going to be until I was 22. My father has never not paid. My mother just doesn't use it for me and states because she is unemployed she needs it more than I. And she didn't claim me on her taxes because I am trying to get independent status for school and financial aid. But I don't want that to come back and bite me in the butt.
