    Default Ex's Husband is Filing Step Parent Adoption

    My question involves adoption law for the State of: California

    My ex-girlfriend's husband has gone and filed adoption against me. How do I fight this? I have spoken to a lawyer and has told me that my chances aren't great. Reason's are 1)I have not paid child support in the last year or so. And 2) I have not made any type of contact or attempted to see my son in the last year or so. With those 2 things in mind I already feel that I have lost my chance to regain my relationship with my son.

    I don't have any proof that in the past I have given her payments "under the table". I have been a part of my son's life since the day he was in his mother's womb. All the decisions that she and I made in the best interest of our son has all been verbal agreements. But with personal vendetta's that she has against me, it makes it hard for me to communicate with her. I still want to maintain a father & son relationship.

    It all boils down to this...
    Can they (ex & her husband) go through the adoption without my consent?

    Can the judge terminate my parental rights, if I still do not consent to the adoption?

    What do I do? Please HELP!

    1. Yes.

    2. Yes. The Judge will consider the child's best interest. Since you have not bothered to support or visit your child in a year that would be a compelling reason to TPR.
