Default Private Arrest for Assault
My question involves criminal law for the state of: California

My girlfriend and I were recently assaulted. When the police came they said they were placing the person under private arrest and that we were obligated to appear at the hearing. I would greatly appreciate anybody who can tell me what that means in terms of the arrest, charges and hearing?

They also said we should receive a letter in the mail from a detective. How long does that normally take?

How long before a hearing will be scheduled?

It means that the police placed them under arrest at your request as it was a misdemeanor not committed in their presence. So, you will have to go to court to testify.

As to the charges, I don't know - I wasn't there and don't know what happened, but I suspect it was for misdemeanor battery with PC 242.

There is no standard time. The arraignment may take place in about 3 to 4 weeks, and trial might be set after that if the DA pursues it.
