    Default Expungment of Convictions

    My question involves expungements or pardons for the state of: California.

    On 01/22/2007, I pleaded no contest to violation of section 23103 Vehicle Code and was sentenced to 3 year probation, fines, and complete a mandatory first offender alcohol related program. Subsequently, on 12/10/2007, I was arrested for violation of Penal Code 243(e)(1). The judge revoked probation and reinstated probation; ordered me to attend 52 sessions of batterers program and pay fines. Now that I have completed this requirement, can I expunge my criminal record?

    Do I have to expunge each case separately? or can it be done under one case, since one court transfered it to another court?

    Please advise.

    Yes, I am still on probation. The judge previously revoked and reinstated my probation from my first case, and gave me summary probation. Yesterda I completed the batterers program and will be filing the completion with the courts tomorrow. Can I at that time file and expunge as well.
    Someone told me I had to wait 5 years.

    You cannot even begin the process until your probation has been successfully completed.

    Your probation will need to be completed or you will have to have obtained an early release before you can file for an expungement.

    Note that an expungement does NOT make the offense go away. It gives you the ability to answer "no" when asked about convictions on employment applications, but still exists on your criminal history and can still be accessed by government for use in certain types of backgrounds or for some future criminal actions.

    Yes, I am aware of that. The reason I want to expunge my record is to be able to say no on employment applications. I have a feeling that I have been denied employment opportunities because of my record. However that will be hard to prove.
