I posted a video on YouTube of pictures sent to me of a television personality doing some compromising things. The photos were posted publicly on a MySpace account. The video was quite damning and received a lot of attention. Low and behold, the person who took the photos filed a copyright stink with YouTube and the video was removed.
I am wondering if the pictures were posted publicly and the person in the photos is of public interest aren't I allowed to post them under fair use? I am prepared to file a counter complaint but I don't want to proceed without at least some council. I am pretty certain that the photos are not protected in anyway so how do I proceed?
