    Unhappy Emancipation to Move in with Another Adult

    My question involves emancipation laws for the State of: New York


    I am 15 going on 16 in a few months, and I am going to get a job. I moved out of my mothers recently because all we did was argue and fight. I couldn't handle it. So now I am residing with my aunt. But now that I am here all we do is fight also. She is constantly fighting with her husband. This environment is too stressful for me. My friends mother is willing to take me in. By living with her I will not have to switch schools. She is a great mother to her kids. She understands what I am going through and knows that it is not the right environment for me. She shows a lot of concern. So I would really appreciate it if I could get some help.

    Life is hard, and only gets harder.

    You're going to need to just learn to get along until you're 18. New York has no statutory provisions for the emancipation of minors.

    And even if it did, before you could be emancipated you would need to be able to show the judge that you were capable of SELF-support, which is the whole point of emancipation. Too many teens seem to have the idea that emancipation is another form of a custody or guardianship change, and that is not even remotely correct.

    im not moving in with my dad, nobody seems to understand anything we fight too much she doesnt let me do anything because she doesnt trust me and I havn't given her a reason not to trust me. I am getting a job and I am able to support myself its not like im moving out on my own.

    yes new york does have laws on emancipation, can they do anything if you leave at 16?

    The State of New York does not have an emancipation statute available or a court proceeding to remove the disability of minority. Rather, the status of a youth will turn on the specific facts of the case.

    No, NY does not have emancipation laws. If you leave at 16, your mother and/or your father can have your rear drug back home at anytime.

    The how come everything I've read on here and other sites it sais that I have to have a stable job and other things like that. I have plenty of time to get a job until I am 16. I will have a steady job by then. I am able to support my self. My mother left her parents at 16. Could anyone please explain that to me I am very confused and in desperate need of help.

    You will NOT be emancipated UNTIL you have a full-time job and supporting yourself 100%. That comes first.
