Default Receiving Medical Care After Workers Comp. Settlement
My question involves workers compensation law for the state of: Nevada

My mother settled her workers compensation claim approximately 2 years ago. At the time of settlement we were informed that she was entitled to lifetime medical care for her injury (right ankle), should she need it. Well, she needs it. Her ankle never truly healed following the injury, something her orthopedic doctor warned her could happen. Unfortunately his warning that her ankle could be worse with surgery than without, was true. The ankle swelling has gotten progressively worse over the last 2 years. Minimal physical activity (a 20 minute walk, for instance) causes rapid inflammation and swelling.

How would she reopen this medical claim? Is she required to see the same doctor who initially treated her for the injury and subsequent surgery? Is she required to contact the compensation administrators for pre-approval? Any help greatly appreciated.

You're stating that she settled her claim except for medical, and future medical was left open? Has she tried simply calling her insurance company and speaking to her adjuster?

Thank you for the reply, Mr. Knowitall. Yes, my mother settled her claim but was told she is entitled to medical care if her injury worsens. She has called the workers compensation administrators who handled the case, but they have yet to return her phone call. She just wants to know if she needs their approval to see a doctor and if she is required to see the physician who initially treated her injury. Thanks again for your suggestion.
