    Exclamation I-130 Query, Has Your Relative Ever Been Under Immigration Proceedings

    Hi,

    I have an urgent question please!

    In 2007 I applied for my (then fiance now wife) for immigration using form I129, in the period between the application submission and the actual interview we got married!
    Now I am filling a new application form I130, and there is a question "Has your relative ever been under immigration proceedings?" what should my answer be?

    FYI, she has never been to the US, she did an interview for the previous application and was told that she needs to fill in the correct form (I130 instead of I129). But now we are starting a new application and I do not know what the answer for this Q should be! some posts say that you put yes if she was ever "deported"!

    If she has ever been under immigration proceedings, she answers "yes". If not, she answers "no". You would absolutely answer "yes" if she has ever been deported.

    Having previously filed an incorrect form, and simply being instructed to file the correct form, is not "immigration proceedings".
