Default Assault Without Visible Injury
My question involves criminal law for the state of: New York

Hi,

Yesterday, my roommate was speaking vulgar lies about me to her boyfriend, that harms my reputation. I overheard it and confronted her. She told me i being a "South Indian" dont deserve to be in the USA. She used very abusive bad words, and called me a prostitute. I am a student and never had any single bad remark on me ever. I told because she was a prostitute, she could talk to me in such a bad manner. She then hit me, dragged my hand, dropped my phone and computer. However, there was no damage to the appliances. My hand had red marks, but they were not bleeding.. I did not hit her back. When i called the police, they refused to book a complaint as i had no visible marks. Does an assault of this type hold any importance in the eyes of law? Can anybody just slap somebody just enough that they dont bleed and get away? This incident has given an immense grief for me. Is there any way i can proceed so that she doesnt get away next time with actions like this?

let me guess what your room mate said:

"no, I didn't hit her"

and with no evidence she did hit you, how do you propose she be prosecuted? On just your word?

It generallly doesn't work that way.
