My question involves criminal law for the state of: California
San Jose, CA to be exact
I was arrested towards the end of last december after leaving a club in San Jose, CA for public intoxication. I left the club to receive a phone call and was standing on the road near the sidewalk. I was going to j-walk across the street. I remember everything clearly, and only had a couple drinks. My court date is coming up, and I am wondering if this is worth fighting? I cannot afford a lawyer, should I plead not-guilty? I am 21, and this is my first offense. Also the citation had a completely different arrest location then where i was really at. This shocked me, the arrest location on the citation said I was around 4 blocks away from where I really was, none of the streets listed were correct. Can I use this to my advantage? Thank you very much.
