    Default Supervision served, now is this on my record?

    My supervision is now served and the judge released me off my supervision in Illinois for Amended Theft 720/ 516-A1 Theft <300 Class A /Illinois. It was considered a deffered sentance and not a convicition. Now that it's all over and supervision was served will people still be able to see this on backround checks for jobs? I know I need to be proactive and have this exponged in 2 years but how about until then?

    Until you qualify for expungement, you probably can't do anything about access to your record. Consult a local criminal defense lawyer about your options.

    I'm sorry, I feel that answer you gave me wasn't even worth writing. I had a lawyer and he told me it wouldn't be on my record but the arrest would. Now I pulled up my records at the court house and I saw it and it said deffered, supervision served, etc. I'm asking what will show on a back round check. Odviously a lawyer really isn't sure because once they get you what they promise up at the court house there job is done. So you really didn't answer my question. The basic question is if you recieved deffered sentancing and completed it and are released from supervision does this show on a back round check?

    In Illinois, if you serve out your supervision without violating it, nothing will show up on a background check. By pleading guilty, and receiving supervision in exchange for the plea, the state is willing to wipe it off your record. You do have an arrest record though. This however, can only be accessed by law enforcment personnel. It is illegal for a private employer to ask you if you have ever been arrested. They can only ask if you have been convicted of a crime (You know, the whole innocent until proven guilty thing - innocent people do get arrested). Because you received supervision, and did not violate it, you have technically not been convicted of a crime. The only time you would have to disclose this information is if you were applying for a civil service job IE firefighter, police officer. Hope this helps
