    Exclamation Is There Any Way That DCS Will Not Intercept My Refund

    My question involves child support in the State of: Florida.

    I am a single mother taking care of my youngest son that is 3, I do not have a job right now and am struggling very hard to make ends meet. I am currently going to school so that I can get a good paying job to pay off my enormous ammount of child support arrears that I have, I think that it is close to $7,000.00. This order for child support is for my two older children which are the ages of 4 and 5, the 4 year old had medical problems and had to have eye surgery, so that is why my arrears are still so high. This will be the third year that the state intercepted my refund check, plus they were getting $200.00 or something garnished from my wages when I held a job. My ex is supposed to be going to request that support be stopped, because he understands my situation and has been taking care of these children pretty much on his own for the past 6-7 months. So, I was just wandering if there was anyway that DRCS will allow me to keep my refund this year, since I am really hard up for money right now, I mean it is to the extent that I have to get assistance from the state and the temporary cash assistance that they give me barely covers my bills, my rent is behind 1 month, it is just really hard right now. Can you think of anything?

    Has your ex ever been on state assistance with the children? If so, then no there is no way to stop them from taking your return. The state wants their money back. If it is going directly to him, then ask him to give you the money back if he is that understanding of your situation.

    It looks like it's time for you to get a job. Correction, past time for you to get a job if you are barely covering your bills, getting state assitance and already a month behind on rent. School needs to be put on the back burner for a while until you get your finances in order.

    Thank you, so much, for your advice, but I am not going to quit school, that is absurd there are other ways, I am going to a couple interviews next week for part time jobs, quitting school is not an option for me, I am not a quitter. I will just be a stronger individual after my journey.........

    As long as you owe the arrears, and they have not been forgiven by court order, you can expect that the state will intercept your refund.

    Has your ex actually filed a motion requesting the court to order the arrears be forgiven?

    If he has, you can try talking to your caseworker to see if they will be willing to hold on to the funds until the court has ruled on ex's request.

    Hi,

    Xena is dead on, As long as you owe the arrears, and they have not been forgiven by court order, you can expect that the state will intercept your refund.

    Also about the arrears. It's next to imposible to have arrears erased, even if the CP agrees to it. BUT, this is what you can do, if the CP agrees. Set the weekly support low, like $10. Arrears will be + $40, or whatever. This will help you with lowering you arrears because the interest and fines are worse than the mobs.

    Even though you are making support + arrear payments, CSEA CAN AND WILL SEIZE BANK ACCOUNTS, 401K, AT ANYTIME, unless you get a court order from the judge that bars CSEA from doing such. Judges very rarely do that, but never hurts to ask.
