    Default Slander/Defamation in the Workplace

    My question involves defamation in the state of: Texas

    A co-worker emailed several other co-workers through company email. She was informing everyone that she had been receiving blocked phone calls at home. She said that other people in the office was receiving the same calls and wanted everyone to know because she filled a police report and the officer said that can be someone who work with you or someone who has friends or family members who work for phone company who has access people account . Another, co-worker responded and said she was receiving the same calls and she also filed a police report.

    First, co-worker said she even got her number changed and still receiving these calls. I resonded and said if you are receiving these calls you should report it to local phone company to start investigation becasue I know someone who was fired from phone company for given out non-published numbers. Two weeks later, I received an email from first co-worker stating I am the person whose been calling her house and that I am crazy and sick etc. She said it was me and my friend who work for phone company. I do have a friend who works for phone company but is out in the field and have no access to anyone account.

    I contact an attorney to get advice on howto handle this issue he sugguested I report this issue to my company I met with my boss and her boss. They met with Human Resources who advised that both boss talk to us becuase we can not be using company equipment for these matters. I never was counsel and follow up with my boss and she said HR met with compliant and this should cease.

    I dropped the issue but she had spreaded these false lies around the company. This happened back 5/2008 and she is still go around telling people she don't like me and I was the one playing on her phone. There are several people who can testify to all of this. Is this ground for slander and defamation suit?

    First, he asked if I think she had any money and said I would report it to your company. That was it. I went through my employee assistance program for this advise.

    In other words, the lawyer told you that you had no case.

    Is that right?

    Well I guess you could say that but he did not know all facts that came later after I contaced him. After researching the definition of slander and defamation I think I have a case.

    No I am not chaning my story. The lawyer basically said "does she have any money, property what do you think you will get from her" I said, I don't know what she has. He said "he would report it to my company". After I reported it to my company I dropped the issue but I am finding out now that she is telling spreading these lies.

    AND (for the third and last time) what did your lawyer say when you asked him your questions (after all this happened)?

    I only talk to an attorney just's once and quoted our conversation in the previous post. I never contacted him after I reported it to my company.
