Default Harassment over a debt
I am having severe problems with a creditor. The debt is my car and the creditor is Chrysler Financial. I understand I am behind a payment due to loss of jobs, and illness, but they are harassing me calling me over and over at one point I had 11 calls on my phone. They call my at my place of employment even after my boss has told them they are not allowed to call, she has told them I may lose my job as a result of their calling. I have answered the phone and they have called me a loser told me to sell my belongings, find a real job. I have tried to set up payment agreements and the have rejected them telling me I was a deadbeat. They have called my inlaws and disscussed my account with them telling them how much I owe and asking them to pay. At one time I was in the hospital and the creditor called my home the person who had answered told them I was in the hospital and he told them that the hospital has phones tell her to call right now! They had told them I am really ill and he laughed about it. She hung up and he called 4 more times asking for me even after she told him I was not available he thought it was a game. This company has literally put me through hell, I have depression due to them, they have made me feel belittled and scared to answer my phone. I understand they are trying to collect a debt but they are way out of hand. I can go on and on about the harassment its embarassing and humiliating...what actions if any can I take to prevent them from degrading me more?

Send them a letter to stop or else you are going to seek legal actions. a good thing to do is tape record them. so long as you are not in the state of washington. check with an official before you record a message. Since in washington, recentley it has ben ruled to be illegal to record someone without thier consent. that would be your best bet, you could try getting the records of calls from your phone company and getting those that this debt collector has talked to rudely about your debt..

also send me a pm with your email adress and i can send you something that may help. almost eeverytime it has gotten those dang monkeys off the backs of people trying to get better in their life.

Default Creditor harassment
Are these calls coming directly from the lender itself, or a collection agency used by the lender?

I believe they are coming from the lender directly because when the guy calls he states he is from chrysler financial and that is who my loan is through

I had to work today, when I got to the office my office manager who is also my best friend told me that Chrylser Financial had called she answered the phone the creditor asked for me she stated I was not there, He then yelled at her insisting that she was me because he says he "knows my voice" she said he was incredibly rude and would not quit calling he was pestering her for a phone number and how to contact me. She told him she was my boss and that my place of employment does not allow creditor phone calls. I work in a Dr. Office. She said he made her so upset that she was shaking it disrupted the whole office....I am writing the letter today... I talked to the guy last week and told him i was posting a payment for the 10th and he was extremely mean and said it was unacceptable, i posted it anyway i dont want my car re-poed. I got home from work and i had messages on my answering machine again from him, and messages on my cell phone.
I am going to be writing my letter stating they are not allow to call me at work....but how should I state it? I gotta get this guy off my back Im becoming a hugh wreck its not only hurting my home life now that im scared of the phone now its interrupting my work also!!

I have many different witnesses to this harassment does that help me any...they are people who have actually talked to them such as my boss and my husbands boss and who they have faught with. My husbands ex-boss is a friend he had a heated arguement with them at one point where they told him i was a loser and told me to sell my posessions to pay my debt for instance sell my house. Can I use this person in anyway he and my boss are willing to help anyway they can!

Check out this website, it helped me with a situation with a debt collector, now I have a lawyer, due the collector breaking some of the rules that they are required to go by.

My lawyer is countersuing the "law office" that tried to collect on a debt of mine, while I was in the verification stage, which they are required to complete. They have not been so mean to my lawyer's staff since he knows that I mean business.

Hope this helps, it's not exactly about repossession, but I would think that a lot of this would still apply.

Folks please note the difference under the law between an original creditor and a debt collector.
