    Question New York Emancipation

    Hello,

    I am a seventeen (17) year old male and I currently live with my parents. I am not in any serious danger, however something could go wrong. My parents are fine, however my living arrangements in New York aren't great. My uncle committed suicide and two of my older sisters attempted it. I am not depressed, but stressed out from the life here. I fear this may become in issue if I remain in New York. My parents agree to letting me leave and live on my own or with my brother. However, as a part-time employee and full-time student, I may not be able to support myself financially, but my brother lives in Virginia, and I plan on moving there in a year anyways. However, I fear that alot can happen within this year. My brother is way more than financially stable to help himself and me, however I can help myself. My brother can say he 'collects $100/mo. for rent' which leaves me with about $400/mo. more to provide me financially.

    1. Will the court agree with this?
    2. Am I allowed to cross-state once I am emancipated?
    3. Would it be easier to just get my brother to become my guardian?
    4. Can I pick my own school(s) and go where I wish once I am emancipated?

    I will still hold my same job in Virginia, since my company is located there as well.

    What it means is that if your parents agree to allow you to go to Virginia and live with your brother, you can; if they do not, you cannot. Even if they will, you will not be legally emancipated; you will still be under their care and control, they will still be legally and financially responsible for you, and they can withdraw permission at any time before your 18th birthday.
