Default Forced Resignation During Workers' Comp Case
My question involves workers compensation law for the state of: Tennessee

I was injured in January of '08 on the job. I was pregnant at the time and had to delay my treatment until after the birth of my child. I was scheduled for a surgery to treat my injuries. My employer had a total bogus claim against me and forced me to resign. I was allowed to receive unemployment during this time. I told the workers' compensation early on that I was just laid off because I really didn't think it mattered. Now that my benefits are coming in, they said they checked with my employer and they stated that I resigned. Therefore, when my dr. releases me, my benefits will stop because I voluntarily resigned and that this will affect my settlement.

My question is, should I tell them it was a forced resignation, and not a voluntary one? Will this help my case if they know I did not quit my job???
