Default Is it Legal to Assess Points Only if You Contest a Ticket

My question involves a traffic ticket from the state of: Connecticut

On the back of my ticket it states the following:
"If you are charged with a motor vehicle infraction or violation and you elect to pay the amount due to the Centralized Infractions Bureau, no points shall be assessed by the Connecticut Commissioner of Motor Vehicles against your operator's license. Such payment may result in administrative sanctions being imposed on you by the Commissioner of Motor Vechicles."

Is this saying that I will not receive points against my license if I pay the fine? It doesn't seem right that if you contest a ticket, you can be assessed points but if you go quietly and pay the ticket you will not be assessed points.

If you don't think it's legal, contest the provision in court. Assuming it hasn't already been litigated the odds are, after you part with many thousands of dollars for the appeals, you'll end up with a court telling you that they're just fine with it. (Somewhere along the line, for some reason, I got cynical.)

Mr. KIA is right. Since you're dealing with a statute, you would probably have to take the case to the State Supreme Court to overturn it. In case you're interested, the provision can be found in Chapter 881b, Section 51-164n, Paragraph (c). Interestingly, I can find NO statute which permits the assessment of points upon a finding of "guilty". But, I didn't search exhaustively.

Where am I going? And why am I in this handbasket?
