My question involves workers compensation law for the state of: Wisconsin
I had two surgeries on my little finger on my right hand. It was pinned twice with a bone graft. I was released with NO work restrictions at 10% permanent partial disability of my little finger. I was tested at a 50% loss of grip in my right hand, plus it won't close all the way. I now have a new job where all day long I lift and dump 50 to 70 pound totes all day. My new employer says unless I get some sort of restriction, I can't be moved. I called my workers comp rep and he said he would NOT OK a second opinion. I called my surgeon and he says he would NOT change the no work restrictions. Every lawyer I talked to says the case is not worth much money. My question is,,, is there any government agency or person I can talk to, to get workers comp to OK a second opinion?
I was going to send you to our sister community, but I see you've already been there.
As noted, you need to consult with a WC attorney.
It's my understanding that you ARE entitled to a second opinion, and that the adjuster MUST OK it. Many will tell you otherwise, however, and this is where WC attorneys come in handy.
