Default Report to Workmen's Comp
My question involves workers compensation law for the state of: New Jersey
The following is an account of what happened during my visits to the doctor for carpel tunnel. In the mid to late 90's I saw a company doctor for carpel tunnel, at that time I was not diagnosed. As the years went on I began to experience more pain and had a ergonomist come out to my desk to assess and some changes were made.
In May and June of 02 I was seeing a neurologist for pain and dizziness at which time the doctor diagnosed me with carpel tunnel. Home therapy and braces was the outcome.
I was on short term disability for another problem when pain persisted I went I see another doctor for a second opinion and he too advised wear braces etc. At this time I reported the carpel tunnel to my company nurse and was not advised to file for workmens comp? Trying to avoid surgery I went to another doctor who advised me to see a hand surgeon. I had hand surgery in Nov 08.
The problem is that I have been on LTD since Augu 2007 and STD prior. Does this affect my statue of limitation (time for filing)?

Yes the first time I noticed the problem with my wrists was in the mid 90's. The nurse sent me to a company doctor who said I did not have carpel tunnel. Then as the years passed I saw my own doctors who said that I had carpel tunnel (2002) and that I should work it with therapy. So this is what I did until June of 2007, at that time I reported to my company nurse who said that my 2 years was up, not sure what she meant. I was out on disability from work for another reason (my son passed) maybe this is why she was no concerned.
