    Default What Happens to a Lien if the House is Foreclosed on

    My question involves a foreclosure in the State of: ARIZONA

    I am on the board of an HOA. The question is:

    If a lien is on a house for non payment of association dues or fines what happens to the lien if the house is foreclosed on?

    Do they just go away or is the bank that foreclosed on the house responsible for them?

    Is a foreclosure the same as a sale?

    A HOA lien survives a foreclosure, when the property is re sold the title company will pick up the recorded lien and it will be paid off once the property is sold.

    The HOA can also bill the current owner (lender) for dues from the day of the foreclosure sale and on.

    That is exactly what I thought but yet I am being told (from our collection agency) that for some reason banks are exempt from that and the lien just disappears in foreclosure.

    I don't get it.....
