hi, I have searched the web and I keep coming up with conflicting answers. We do have a lawyer but I would like to hear from someone else too so I am not relying on one person.
My husband injured his primary wrist at work. He was out of work for almost a year and had a revised surgery (our understanding is this surgery has only been performed at tops 10 times, not that I think it matters but thought I would put that in). At best he will regain 75% strength and 50% mobility in his wrist. It still hurts him just to sign his name finished his rehab over 6 months ago. They don't feel he needs more rehab since he is almost at the 75%/50% mark.
Anyway on to my question...
I have read for permanent partial disability (which i assume that is where he would be classified) in IL it is a max of 3 years salary as a compensation. I have also read up to 500 weeks (which is well beyond the 3 years) and one other I have read had nothing to do with a salary but with the extent of the injury. At this point I don't know what to believe.
What I do know is the original offer was about 5 months salary and the lawyer rejected it pretty much on the spot.
Also I wanted to know do they deduct the pay he received during his medical leave from the settlement amount. Meaning if lets say it is a 3 year cap and he was out for a year would they cap it at 2 years?
