Default Auto Written Off But Still Have Vehicle
My question involves an auto loan or repossession in the State of: Texas.
I have not been able to make my required payments on my vehicle for 6 months. Loss of hours at work and other financial obligations plus I need it to get back and forth to work. The finance company has written off the loan on my credit report. I have no title. The wrote off balance is in full for $26,000. I have left the vehicle in my drive for them to come and get but they have not came out to get it. I do not get any phone calls from the finance company anymore. I don't won't to just take the vehicle to them and leave it. I figure if they really want it they will come get it. Do i have any leverage being that the vehicle has been written off and the finance company has already probably gotten compensated for their loss?

You can leave it until the come and repo it but you have no leverage. It will appear and remain on your credit report for between 7-10 years. You defaulted on the loan and that's what happens, whether it's written off or not.

Writing off the balance is just an accounting entry. You defaulted on the loan & it is still your debt.
