    Default Evicting a Roommate Who is On the Lease

    My question involves a roommate in the State of: California, San Diego

    My roommate and I just signed the lease for one year two weeks ago. Now she refused to pay the security deposit which she owed me and the rent. She's only willing to pay portion of the rent which is about $175 less than what she's supposed to pay. She's also a racist, making racists comments about me and my nationality on a daily basis. Also she substantially interfered with me about lowering down her rent.

    Although we're on the lease, but I found the apartment first. She answered to my ad about the small room, and we both have signed the "housing rules" which indicated the rent she needs to pay monthly.

    I am just not sure in my case, which I am not a "landlord", but as a senior resident, can I evict her through legal process?

    You can't evict your roommate - she's not your tenant. I have no idea what the "housing rules" are, who wrote them, or what they say; if she doesn't pay you money she owes you, you can sue her for the money she owes in small claims court.
