    Question My Apartment Towed My Vehicle Without Warning

    My question involves towing laws for the State of: Minnesota

    Me and my roomate live in an apartment that is normally pretty good about keeping us informed. Well last week, my buddy went outside to find that his car was missing from the lot. We called the police to report it stolen and they suggested calling the towing company that the apartment uses just in case. So we did, and found out they towed MANY peoples cars that night because the apartment plowed the parking lot.

    Normally, there is a sign on our doors about week before they plow. The sign that they normally post says: "We are going to be plowing at (Said time) on (Said Date). If vehicles are not moved, then they will be towed at owner's expense."

    Well, we checked our side of the building, which is three doors and we have pictures to prove it. There are NO signs. On the other side of the building there was one sign.

    Now what I want to know is what are my options. My buddy and I want to break the lease and leave, is there any way we can have them credit the towing fees towards our two months rent? Or what can we do?

    On what grounds would you terminate your lease? Him having his car towed is not legal grounds for this. If you can prove there was no notice posted (what's to say someone removed it), you can bill the landlord for the towing/storage fees. But again, it's not grounds to terminate your lease unless the lease specifies what happened as a breach (doubtful).

    If you did prove that no notice was posted and you do break the lease, you and your roommate are responsible for payments on your unit until it has been re-rented - you could stand to lose quite a bit of money.

    OK, well my buddy and I are not able to afford to living here, so we have to breach regardless.


    How would I go about billing them for the towing if we can prove there was no notice.
