Default Worker's Comp Settlement
My question involves workers compensation law for the state of: NC

My husband is having a mediation hearing next week (1-26-09). This is the first one we have been to and we are hopeing to settle his claim at this meeting.

My husband has had 2 back surgeries, fusions with instrumentation, L4-L5 and then the S-1. He has a great deal of pain still and he will need pain managment for the rest of his life and possibly more surgeory. He is on Social Security Disability and 3 doctors have said he can never work in any capacity.

My question is what is a resonable settlement? Wea re thinking around $200,000.00 with the attorney getting 25% of that. Is that way to much to expect? If so what would be reasonable?

You need to be asking that question of your attorney. It is fact specific and also state specific.

Hello Becky-

If I were you I would ask for the most ridiculous amount and see what happens, look up compensation for your husbands injury on-line and go from there. Your husband is going to suffer for the rest of his life, the amount is never to small. That's just my opinion My husband and I have been dealing w/his case now for almost 2 yrs w/out an attorney and I'm glad we didn't get one. However from my experience I know for a fact the insurance company will try to pay out as little as possible, and if you plan to settle everything Medical and Disability, then 200,000 is way to low. You need to settle for an amount that will retire your husband for good. Or do not settle on the Medical, make sure he gets it for LIFE. Why the heck not- his injury is permanent. It's going to hinder him for the rest of his life, you can't put a price on his back. Good Luck

Thank you for your response and kind words. My husband did settle his case yesterday. He got life time medical ...plus a large clincher ...although the clincher wasn't exactly what we wanted...it was still a good settlement considering they will take care of his back for the rest of his life. I even have to say the lawyer for the worker's comp insurance company was very nice, and the first words out of her mouth was that they took full responsibility and would take care of his medical bills for the rest of his life!
