Getting My Capital Back

My question involves business law in the state of: Maryland.

Hi Guys,
This is my first post.
I partnered with another person to do business and we were not getting along so I have withdraw myself from the company. Prior to leaving the company we have signed an agreement that he has to pay my capitol once I leave the company, it's been several months and I've been trying to get the money from him.
Now he's telling that he can't pay the money and asked me to seek for the legal help if I want to.
I want my money but since it's a small amount, I don't want to spend it for the lawyer.
Please advice me on how to proceed.

If it's a small amount, contact your local small claims court to see what the limits are. Then file with them, you don't need an attorney. Most court info is online these days.

Your welcome, good luck. If you go thru and win, make sure you ask the someone in the court how you go about collecting a judgement. Get any forms while your there.

hi,
here is another new problem. When I was asking him for my money back, he was offered me that he would finish my website without any charges to me.( I have not signed any contract, estimates or even invoice). In return he wants to extend the payment date. I agreed and he completed the site. Now he's coming back telling that he want to charge for the website and now we are equal and he doesn't owe any money to me.
Can this possible? Can he bring this against me in the court?

Yes he can bring this up in court, but will it work as his defense? I doubt it. Was there anything in writing regarding just the part to extend the payment date and the site?
