Default Breaking a Lease Because of Black Mold
My question involves a condominium located in the State of: Florida

Hi, We moved into our condo in Palm Harbor about four months ago and have until May 30th on the lease.

We recently discovered that the condo below us (which is a bank owned foreclosure) has serious black mold issues.

We contacted the real estate agent about our concerns and she had a company air test our condo. It came back positive, but they now need to retest specifically for black mold which will take another week.

my question : do we have any legal rights to break our lease and get back the security and last month deposits ????

Obviosly, I've very concerned for my health !!!!! Thanks for your help.

You don't have any remedy against your lease based upon mold spores alone. Mold is quite common, and most mold is not toxic. Please let us know the results of the follow-up test.
