Default Third Party Employer
My question involves workers compensation law for the state of: California

I have a contract with a web based company that sends work or Job Listings via e-mail to me. This company requires that I accept or decline the job based upon my ability to contact the construction project manager or builder and set up a time for me to complete the request.

If I accept the job that means I have contacted the builder and will turn in a construction (percentage of completed work report) on the project with-in 48 hours

I am required to set a date and time to complete the work with the contractor
or builder, and be at the job site on time to meet with this (third party) at the location I have been asked to complete the report.

After the report is complete I am required to fill out the report in a specific format and e-mail the report back to the web based company.

During one of these jobs I was injured. The third party says that he did not hire me. and states that his workers comp insurance is not responsible to pay for my medical treatment.

From what you say, they're simply a broker - they connect you with contractors who wish to hire you and collect a percentage of your contract price as their fee. They don't employ you, don't pay you, don't decide your wages, don't dictate what contracts you take or reject, don't supervise you on the job site, etc. In which case they're not your employer.
