Unhappy Being Charged with False Pretenses
My question involves criminal law for the state of: MI
My daughter's father and i had an arrangement outside of court fo rchild support so on aregular basis he would write me and postdate checks for a month at a time well anout 4 months ago he wrote me a check and i deposited it in my bank and it bounced so i called him and told him it bounced and he needed to replace the check for $125 so he said ok ..well 2 days later he called me back and told me to just change the date on one of the checks i still had and initial it and he would give me another check when he came to my sid eof town (45 miles away) well 2 weeks ago i get a letter stting that he filed charges against me for false pretenses claiming i altered his check without his knowledge??? so they have brought charges against me for false pretenses- i calle dthe investigator to ask why he didnt call me to discuss the matter and my ex told him he didnt know my contact info although he calle dme a month ago on the same phone i have had for 3 years. He is only doing this because we broke up i have moved on an i filed a police report against him for busting out my windows in my car--the investigator says it comes down to me changing it whether he said to or not? Is there anything i can do about this because not only did none of the checks cleared his account they all came back NSF and i still have the checks showing i paid all the fees associated with these payments he took no loss at all...I dont understand what i can do i feel helpless ..please help

Why didn't you simply redeposit the bounced check?

You haven't told us who "the investigator" is - are you talking about a police officer?

Do you have a lawyer yet?

well my credit union tried to submit nsf check 3 times and after it didnt clear the 3rd time they gave me back the check and advised me togo to his bank but his bank wouldnt accept ti because it was already stamped, the investigator yes is th epolice and no i havent gotten a lawyer yet and i go to court for this on Monday.
