    Default DUI Reduced to Negligent Driving, Washington State

    My question involves criminal law for the state of: Washington

    I was pulled over for speeding (33mph in a 25 zone I thought was 35mph) and arrested for DUI after a .085. My lawyer has gotten a plea deal of negligent driving 1st degree which comes along with a 90 day prison sentence (89 suspended), fine, and 2 years probation. I am trying to figure out the conditions on the probation to decide whether or not I take it to trial or accept the plea (particularly important are leaving the country and gun ownership/access, as these will cost me my job and living arrangement.) Does anyone have experience with the typical probation conditions for a neg 1 in Washington state? Note also that the probation goes from active to inactive upon completion of alcohol evaluation and required classes, which are already in progress.

    If you go to trial, your defense will be what?

    If the answer is, "I don't have a defense", how will going to trial help you - other than getting you a more serious conviction and a stiffer sentence?

    My lawyer says its 50/50 if we take it to trial. Its his job to come up with the defense, my job to decide what to do.

    Lawyers don't lie for us. Lawyers defend us. It sounds like you lack a good defense and the deal is pretty nice. Most jurisdictions in WA are not making deals.

    Negligent driving in WA is a misdemeanor and it drops the DUI charges. For now you should not have a problem getting a gun and/or getting into Canada. ...just don't take the gun into Canada. Rumor round the watercooler in Seattle is Canada is starting to look at DUI arrests under the pressure of the MADD moms in their country.
