    Question Laid Off While on LNI

    My question involves workers compensation law for the state of: washington

    I hurt my shoulder at work and filed an LNI claim....been going to a ortho and he has me doing physical therapy..been doing my job with the help of my husband.(my employer knew this and I thought doing the company a favor for not going out on disability)...not receiving money assistance from LNI...(just medical)..I have now been laid off from work...the dr. is supposed to tell me if I have to do surgery in 2 weeks.....so now with being laid off will I be getting payments from LNI????..I don;t think I can apply for unemployment....I am willing to work full time but depending on the job requierments might not be able to do so.....please help...

    You haven't indicated if you are capable of working, or why you were laid off. If you were laid off due to your injury, you should be eligible for worker's compensation benefits. If not, you should see if you qualify for unemployment. If you are unable to return to work for a period of time, despite qualifying for unemployment, due to surgery, you may be able to collect worker's comp benefits during your period of disability even if you otherwise qualify for unemployment benefits (which typically require you to be able to work).

    I saw my dr. today and I am not able to use my right hand...(which is my dominate hand) only can lift 2 lbs,...told me to continue physical therapy for a month and then if not any better surgery is the next step.....I could do my old job because they allowed my husband to help me......I was laid off to business being slow.....that was what I was told.....
