    Question Establishing Paternity After Father is Deceased

    My question involves paternity law for the State of: NY/ Florida...nj?

    I will try to make my confusing inquiry short... although its tough.

    My father passed away this past week and I am looking to find out more about my rights as his "next of kin".

    My father resided in Florida since 1985, however he is orginally from NY. NY is where I was concieved & born(1980). It is also where my parents were married (and divorced-83-84). NY is also ironically, where he passed somewhat unexpectedly in his family's home.

    Right now, his siblings have taken the reigns of taking care of all of his arrangements- however I am a little concerned with their handling his estate because I do not believe they will be including me as I should be included on the technicality that his name is not on my birth certificate (there is no name). However, everyone knows and acknowleges Im his child.

    Because of his turbulant relationship with my mother the family has never FULLY accepted me he had his life with them, and then his life with me..and times that the 2 crossed paths few and far between. The family (intentionally or not) acted as if I was their guest at my fathers services, and I was quite upset that I was not asked if I wanted an autopsy done... because I did for family medical history. So now, I believe they want me to have limited to no inheritance also. The house he passed away in was part of his father's estate that is still not fully settled, and is also where 2 of his siblings reside, so I believe they are afraid of me getting involved with that.

    I do not know if I can establish Paternity in NY or in FL.. .or NJ? (cause I reside there now), what the laws are, what my rights are, and I would just like to know my options... any insight?

    Did he leave you anything in his will? Does his will mention you at all, or make reference to any children or heirs other than those named in the will? If so, what does it say?
