    Default IRS and EDD Civil Penalties

    I had a Business and incurred debt liabilities to the IRS and EDD which resulted in civil penalties I have since went through the process of submitting financial statements and a request for Offer and Compromise since this whole ordeal I recently got married and my current husband had nothing to do with my previous debts yet the revenue offer and compromise specialist is asking for his financial information? we have never filed any taxes? we only been married 11 months? and do not intend on ever filing taes together? and I also did a pre-nuptial will teh IRS hold him liable also for my tax liabiilties? they are going to put a lien on my credit? will they do that to him also? will the ruin him as well? what can be done toprotect his credit and income which is not much since I am the bread winner? do we have to divorce? for relief? Really need some sound advice on this matter? The civil penalties are stiff and high

    The are asking for his financial information in order to help them determine whether or not your proposed offer in compromise is reasonable.

    Basically, they are going to determine if they would be able to collect more from you during the statutory period that they can collect the tax, than what they could get from your offer in compromise. Your husband's ability to contribute to the household expenses is a fact in all that.

    However, that will not make your husband liable for your tax debts in any way, nor can they put it on his credit report.

    I would strongly recommend however, that you and your husband not own any joint assets or have any joint bank accounts until your tax issues are resolved.
