Default Fraud in an International Car Sale
Hi
I bought a 1946 Cadillac on ebay, before I placed my bid I asked the seller if the car was complete and got a letter from him where he tells me that there are only 2 foglight lenses missing. When I got my car it was an empty body, all expensive chrome trim is missing
The trucking company spent 2,5 hours extra there trying to get my parts but gave up
I have talked with him and he tells me that he is going to send the parts but it is now 4 months since I paid for the car and no parts. Buying all missing parts would be almost impossible and cost a lot of money. I have paid $8100 for the car and then had it shipped to Sweden so the total on it now is about $14000. As it stands today the value is close to $
The seller has a registered Hot Rod shop. What is the best thing for me to do?
Can I sue him?

You're in Sweden? He's probably counting on that distance as making it virtually impossible for you to sue or criminally prosecute. I don't suppose you paid through a service that offers a guarantee on the merchandise purchased, or through an escrow service....

Can it really be so easy for him to get away, I have a contract with him and also a letter where he specifies what goes with the car. I have everything documented from the purchase until delivery. Also have letters where he admit that he hasn’t fulfilled his part of the deal
I don’t know if it makes my situation better but the seller have a company (Hot Rod shop)
It is reported to both NY state police and IC3
Is it impossible for me to sue anyone in USA when I’m from Sweden? If it can be done what’s the best way?

Yes, it was an ebay auction. All correspondence about what was included in the deal was going via ebay so that is documentet and I have saved all e-mails I have sent to him and everything he have sent to me.

Well that will help.

Log onto your ebay account and "OPEN A DISPUTE" with ebay on the accounts services page. Give them detailed information as you did on here and they will mediate this for you.

How did you pay the seller? Paypal by chance?

You have to open a dispute in 60 days and after that you don’t get any help from ebay.
Ship a car to Europe take a lot of time so the 60 days have passed and after that you don’t get any help from ebay
Payment was wired to his bank account

What does the feedback look like for this seller? is there a pattern of this? (what he did to you) or are you an isolated situation since you live so far away?

He has a 100% positive feedback (317) so to be honest I don't understand why we are in this situation. He has a Hot Rod shop and risk the reputation for this is just so unbelievable stupid, things travel fast on the internet and I guess it would be bad for him if it get out

OK, go back and look at his feedback now. The other items he sold, where they $14,000 USD items like he sold to you or are they $5 USD items? The feedback number is not as important as the kind of items he sold to others.
If he is selling $50 items and suddenly a $14,000 item that is a indication right there that something is wrong.

I have seen people do alot of things like this for alot less money then you paid.
