Unhappy Threatened with Prosecution by Check Cashing Store
My question involves criminal law for the state of: Colorado
Hi I could really use some help, I cashed a check written to me for a partial payment on a truck I had sold, it was only for four hundred, but I just got a phone call saying if I don't get to the check cashing place and pay back what I cashed then I will be held liable and I will get a Felony Theft charge! I am a single mom of one and am already having a hard time finding work.
Is this my fault?? I dont know what to do.. I can't pay.. no money.. Please help??

Yea the bank had insufficient funds. The buyer? If you mean the "check writer" he said that he's not working right now and can't pay it either. I have not sent him the title to the truck that I sold him and don't plan on it till he can pay it. But that is pretty much pointless seeing as I'm going to be in trouble... What do you think???

I think you need to call the police and get your truck back, or just go get your truck back. Then, I would do what I could to get the truck sold as soon as possible to pay the check cashing place. Think about it, if the person wrote you a bad check and took the truck (and apparently knows he wrote a hot check) then there is a good chance that he didn't insure it. Your on the hook if he hurts someone.
For future reference, if someone writes you a check, cash it at their bank to avoid problems like this in the future. Or you can always say "cash only."
