My question involves adoption law for the State of: Virginia
Who would be the next of kin to a child if their mother dies and the biological father's parental rights were terminated?
No, the step-father has not adopted the child.
In the context of adoption proceedings, I would expect the child's guardian to serve as "next of kin". Can you clarify the context of your question?
I apologize, I believe my post maybe in the wrong forum. My boyfriend voluntarily signed over his parental rights but refused to sign the adoption papers for the step-father to adopt him. The mother allows the son to talk to the biological father. I know this sounds confusing I still don't understand it but anyways my boyfriend is under the impression that if the mother dies he will get the child but since he signed over his rights I didn't think he would be considered the next of kin.
