Default Issuance of a Bad Check
My question involves criminal law for the state of: Texas

Last year I was arrested at my residence on a warrant for the issuance of a bad check.

I was taken to jail and spent 40 minutes in jail until my roommate pulled the funds out of my bank account to pay for the amount of the check.

The total was $265 is what was paid in a money order to get me out of jail.

My question pertains to my criminal record. Will this show up on my record? I was never given a chance to get deffered adjudication, so I'm worried that I will never be able to get this off my record.

Any insight would be appreciated.

Yes, the arrest is likely to show up on any background check. You can read the requirements to try to have it expunged at

http://tlo2.tlc.state.tx.us/statutes...0.htm#55.01.00

or can hire an attorney to help you through the process. Keep in mind that even if expunged, there could still be records of the arrest that an employer could find (in everything from newspapers, to other public and private websites, to sheriff's office call records, etc.), and law enforcement will still have access to information about the arrest.

It isn't so much the arrest showing up that I'm worried about. It's more of having a misdemeanor show up on a background check.

Since the disputed amount was paid shortly after the arrest, this is where my question lies. Is this the same as pleading guilty and having the misdemeanor show up on the record? I never saw the judge or was given a summons after release. The amount was paid and I was let go.

Thanks for the advice.
