    Default No Will, No Rights

    My question involves estate proceedings in the state of: ca
    I was in a car accident which left me carless and so my father let me use his truck and told me not to worry about the payments. He passed away recently and my stepmom told me that I was no longer allowed to use the truck. I am willing to take over payments for it, what can I do to keep it? My stepmom has her own vehicle(paid in full by a life ins. policy on the loan) that she can't drive due to health issues of her own! The truck and her car were registered to my father only. I moved in, took time off from work for the last two monthes to be my fathers caregiver and need to return to work but now have no vehicle to get there in! He left no will, my stepmom is kicking me out, selling the house and refusing to honor my dad's verbal agreement that she was fully aware of.

    When somebody dies without a will, his estate passes in accord with the laws of intestate succession.

    Go down to the courthouse and file for probate and ask to be named the presonal representative of his estate. While you are there, check the deed to the house to see whose name is on the deed and the exact wording.
