    Default Still Legally Married

    My question involves child support in the State of: CA and TX

    My mother and father were married in Mexico. They were never legally divorced, even though they have not been together for 35 years. They had four children together, which my mother never collected child support for. My father remarried. My questions is does my mom still have the right to take him to court today to collect for that child support? She lives in CA and he lives in TX.

    If all of the children in question are now adults, and mom never bothered to file for support, the court isn't going to entertain such a motion at this late date, especially if they are still legally married (your dad's current marriage may not, in fact, be legal if he never divorced mom).
