My wife's visa was expired in March of '08 when we were coming back into the country from our honeymoon. She was told by Customs to leave on the next available flight back to Mongolia. She did not leave and a few days later we were actually advised by her immigration lawyer that she would have better chance for her I-485 application if she remained in the US. In November, as part of our I-485 Immigration application process, we went to an interview at Immigration office in Fairfax, VA. During the interview, they detained my wife and began the process for her deportation. The issues she faces are: failure to follow order to voluntarily depart and also she made comments during the customs interview in March that she wanted to live here in the US, even though she was here only on a travel visa. Also, due to unfortunate circumstances, our marriage was her third in about 5 years so Immigrations is suggesting possible fraud. Given her circumstances, once she is deported, is there any possible way for her to be granted a waiver based on I-212 or I-601? Thank you very much,XXXXXXXXXXXXXXXXX, VA
