My question involves malpractice by a lawyer in the state of: California/Pennsylvania
I hired the services of a lawyer on June 3, 2008 to assist with a divorce that I originally tried to do over the internet which kept getting rejected for one reason or another. I paid the retainer of $1500 on the 3rd of June. Over the next few days they got my information about my original case. After that, nothing happened until November, 17 when he dismissed my original case and started a new one. The new case wasn't entered into the new county court until Dec 9th, 2008 and the paperwork was sent to a process server on the 11th. I got served on the 17th by a PA lawyer for custody of our son and now my lawyer is telling me I need a PA lawyer and he can't do anything anymore. He won't even tell me if she had been served before I was, which, I understand would negate any of her paperwork.
What can I do to, at the minimum - get my money back or the unused portion of my retainer to hire competent lawyer in PA?
