    Default Change Order

    My question involves real estate located in the State of: Canada

    We completed a chabge order for the colour of our banister about 40 days ago. We noticed 2 days ago that the builder stained the banister to the original colour choice instead of the change order colour. We called the company and they admitted they made a mistake but said since it would cost too much to make the change they cannot be legally required to correct the problem.
    Are they correct?

    hercdriver; just to give you what would happen here;

    it would fall under the "I don;t care how much it costs you. We have a contract and you are required to fulfill that contract. You screwed up so it is your fault there is any cost involved so tough cookies guy, fix the color" doctrine of construction law.

    Either that or your negotiate a discount you can live with for him leaving the color what it is.
